The submission is in the form of Report and Brochure. This should be written in a concise, formal business style using single spacing and font size 12. You are required to make use of headings, paragraphs, and subsections as appropriate and all work must be supported with research, including case laws, and referenced using the Harvard referencing system.

Case Study – Formation of Contract (Fisher v Bell 1961)
Invitation to Treat
Under the ordinary law of contract, the court determined, that the display of an article with a price on it in a shop window is an invitation to treat and therefore not an offer for sale.

The claimant: A police officer (Fisher)
The defendant: a shop owner (Bell)
A flick knife was exhibited in a shop window with a price tag attached to it, the court had to determine whether this amounted to an invitation to treat or an offer for sale. If the presentation in the window was an offer for sale, the defendants had committed an offence under the Restriction of Offensive Weapons Act 1959 which prohibited the offering of flick knives for sale. The police sought a prosecution for the offence, but the court used the law of contract to determine the display as an invitation to treat and therefore not an offer for sale. The police officer (Fisher) sought an appeal.

The aim of this unit is to enhance students’ understanding of how business law is applied to the running of a business organisation. Students will gain knowledge of business law and examine the impact of the law on business operations and decision making.

Throughout the unit, students will identify the legal solutions available to business owners and assess their suitability. The experience that students gain in this unit will help them to better understand the different areas of law that apply. Wendy is a Portuguese citizen who has been operating a Dormitory Hostel in West Bromwich for EU students near to her home. A new owner Jason of the next door butcher shop often keeps his bins open in the back garden. That has been causing a huge nuisance to hostel residents.
