The doctor is refusing to prescribe stronger painkillers because of their serious adverse effects and possible addiction. But the manager and staffs cannot see Mrs. M suffering by screaming and wandering throughout the premises asking for help.)

SCENARIO for Task 4

Today CQC publishes the findings following an inspection of services provided at ABC Care Home Ltd. After considering a range of evidence inspectors conclude that the registered provider, ABC Care Home Ltd, had failed to ensure that people living in the Care Home were adequately protected from risk, including the risks of unsafe practices by its own staff.

The report concludes that there was a systemic failure to protect people or to investigate allegations of abuse. The provider had failed in its legal duty to notify the Care Quality Commission of serious incidents including injuries to patients or occasions when they had gone missing.

Inspectors said that staff did not appear to understand the needs of the people in their care, adults with learning disabilities, complex needs and challenging behaviour. People who had no background in care services had been recruited, references were not always checked and staff were not trained or supervised properly. Some staff were too ready to use methods of restraint without considering alternatives.

Inspectors who visited ABC Care Home considered taking urgent action to close the center, but decided that it was in the best interests of the patients to allow NHS and local authority commissioners further time to find alternative placements.

CQC ensured that there would be an immediate stop on admissions and that extra staff would be brought in to protect patients until they could be moved.

The report which is published today finds that ABC Care Home Ltd was not compliant with 10 of the essential standards which the law requires providers must meet. CQC’s findings can be found below.

• The managers did not ensure that major incidents were reported to the Care Quality Commission as required.
• Planning and delivery of care did not meet people’s individual needs.
• They did not have robust systems to assess and monitor the quality of services.
• They did not identify, and manage, risks relating to the health, welfare and safety of patients.
• They had not responded to or considered complaints and views of people about the service.
• Investigations into the conduct of staff were not robust and had not safeguarded people.
• They did not take reasonable steps to identify the possibility of abuse and prevent it before it occurred.

• They did not operate effective recruitment procedures or take appropriate steps in relation to persons who were not fit to work in care settings.

Hence, it will be necessary for the care workers and professionals to respect the rights of the care users. The culture as well as set of beliefs relating to various people is different. Therefore it will be necessary for the care workers to project respect to the diverse cultural background of the other service users and their belief system. Moreover, it will also be the duty of a healthcare setting to allow the service users for making their own decisions towards care and medication. For this purpose I am required to develop an appropriate system through which I will be able to monitor the performance of the staffs and the quality of care offered to the patients. For this purpose I will conduct performance appraisal sessions, where I will compare the performance levels achieved by the care staffs and the quality standards developed. I will also collect the feedbacks of the service users to track any incidents of abuse or harm caused to them by the care staffs. I will develop a new policy and mechanism through which it will be easier for the organisation to report to the Care Quality Commission about the major incidents occurring in the health care setting. Being in the position of a manager I will also take active initiatives to develop a risk management framework, where I will be able to develop an appropriate risk management framework to identify and evaluate the various risk factors, which the patients and the workers might get exposed to and formulate effective policies to mitigate the risk factors. I will formulate a policy towards preventing abuse of service users, in case of any incident of abuse or harm, there will be a quick response team, which will investigate into the situation and take effective action against any staff for abuse of service users (McCarthy and Rose, 2010).

I will focus upon retrenching the staffs that lack skills and develop a new recruitment framework, where eligible candidates with necessary skills and experience will be selected. Moreover, a new training system will also be developed where the development needs of the staffs as surfaced through the performance appraisal program will be met through training.

4.2 Evaluate your own contribution to the development and implementation of organisational policy in ABC Care Home to rectify the shortcomings pointed out by CQC.

Being a manager, I experienced varied difficulties in managing the policy concerning the ABC Care Home. I have realised the fact that, it is critical for me to understand, follow and properly integrate the various regulatory requirements operating in UK in the policy of the organisation for ensuring the appropriate management of the concern. I have developed and implemented a series of strategies that will ensure that the service users are getting quality care and their needs are being fulfilled properly.

On the other hand, I have also experienced the fact that the employee base at ABC Care Home is not adequate and they lack appropriate skills and hence, it become difficult for me to properly implement the strategies framed by me to enhance the quality of care provided to the service users. As a result of that, I have developed an appropriate recruitment plan to select the eligible candidates who are capable of meeting the objectives of the organisation. I have contributed towards the reputation of the care home by developing system that will detect any incident of abuse or harm caused to the service users and I have also set penalties for such acts. This mechanism calls for collecting the feedbacks of the service users regarding their level of satisfaction. I have contacted each and every service users and communicated with them in an effective way in order to develop a bonding of trust with them. I have taken active steps to discuss the responsibilities with the staffs and provided them appropriate directions so that the number of errors is minimised substantially. I have also focused upon staff development, where I have developed a performance appraisal framework to track the development needs of the staffs and a training process through which the development needs of the staffs are met (Buttaro and Buttaro, 1999).

I have also developed a framework, which will help in reporting to the CQC of any major incidents occurring in the organisation.

4.3 Make recommendations to develop own contributions to meeting good practice requirements in ABC care home in the future.

In order to ensure that the quality of the practices conducted in ABC Care Home is enhanced substantially, the most important step which the management is required to take is to educate the staffs and provide them appropriate training. The management is required to properly identify the areas of improvement relating to the performance of the staffs and take active steps to improve those areas through imparting knowledge and training to them. In this way, the staffs at the care home will be able to develop their skills to provide high quality services to the care seekers. Apart from this, it is also recommended for the management to integrate evidence in practice, as the same is capable of enhancing the quality of the services provided to the service users to a greater extent. This can be done through conducting effective research upon the bset practices conducted in different health and social care settings in UK and implementing such example sin the care practices conducted at ABC Care Home (Buttaro and Buttaro, 1999).

Moreover, the management must also take active steps to provide appropriate guidance to the staff members and recognising their contributions towards improving the reputation of the care home must also be done to motivate them to work better.
